Female Farm Workers Win Sexual Harassment Suit

Posted in Sexual Harassment News
FLORIDA – A group of female workers at a Florida tomato farm have won a sexual harassment lawsuit.
According to the suit, DiMare Ruskin, one of Florida’s largest growers, was found guilty of harboring a hostile work environment in which several female workers experienced unwanted sexual advances and touching, despite coming forward with complaints.
The plaintiffs also claimed that after they brought the complaints to management, they were fired in retaliation.
The women then turned to the EEOC, which filed the lawsuit against DiMare last year in U.S. District Court for the Middle District of Florida.
This week, the EEOC announced that the company will have to pay a $150,000 settlement to the sexual harassment victims.
As part of the settlement, DiMare is required to implement an anti-harassment policy, create a system for employees to submit harassment complaints, and provide training about the EEOC’s anti-discrimination laws. In addition, the company also has to report to the EEOC regarding sexual harassment complaints for the next three years.
Sexual harassment is prevalent at many farms, with women being the majority of the victims. However, anyone can become the target of a sexual predator. Both men and women can be offenders or victims and either can be of any age, race or sexual orientation.

CALIFORNIA – A prominent Silicon Valley’s venture capital firm must go to court for a gender discrimination and retaliation lawsuit.
San Francisco Superior Court Judge Harold Kahn denied Kleiner, Perkins, Caulfield & Byers’ request for a “closed door” litigation process and the trial will now be public.
The lawsuit was filed by Ellen Pao, 42, a junior partner who joined the firm in 2005, on May 10. Pao alleges senior partners at the firm failed to stop a colleague from harassing her after she ended a sexual relationship with him.
Pao also alleges the firm discriminates against women, making it difficult for them to advance their careers and pay at the same rate as their male colleagues.
The firm denies the allegations, contending it was not her gender, but Pao’s job performance that prevented her from advancing.
Pao is currently still working at the firm.
Women like Pao face sexual harassment at work on a daily basis. However, despite the majority of victims being female, anyone can be the target of unwanted sexual acts. Victims can be of any age, gender, sexual orientation, or race. Equally, harassers don’t always fit a stereotypical mold.

A complaint has been filed against a female manager at a Long Island-based national women’s organization over sexual harassment.
Krissy DeMonte allegedly engaged in repeated sexual harassment incidents against females at the National Association of Professional Women in Garden City between September 2010 and March 2012.
According the complaint, DeMonte would slap several women on the buttocks, calling them names like “vixen,” “cutie” and “hottie,” in addition to insulting them.
“She’d say you’re hot, you’re sexy, no wonder why all the guys love you,” said one of the alleged victims, plaintiff Monique McCabe to The NY Post. “I was extremely humiliated. I felt disempowered. I didn’t know what to do. I felt lost.”
McCabe’s colleague, Crystal Alexander, said she suffered similar sexual abuse.
“She would pass my desk, and while I was standing up she would smack me on my behind, grab my butt and pinch me as well,” said Alexander.
McCabe and Alexander complained to the company’s human-resources department, but when word of the complaint reached DeMonte, McCabe claims she became hostile and retaliated against them by writing them up and eventually firing them.
A provocative Facebook photo in which DeMonte is depicted shoving another woman’s face into her breasts has been used in the case as evidence of her behavior.
Many people are under the misconception that sexual harassment only occurs between a man and a woman, with the man as the perpetrator. However, as this incident demonstrates, sexual harassment can occur between anyone, regardless of gender, age, ethnicity, or sexual orientation. If you have been subjected to unwanted sexual abuse, turn to a sexual harassment lawyer immediately to file a case.
Sexual harassment lawyers will defend your right to a workplace free of hostility and will see to it that you obtain compensation for your pain and suffering.

Sexual harassment may occur just once, or persist frequently. But regardless of the individual circumstances surrounding each case, it is important for victims in Minnesota to know they have options.
In Minnesota, every employer should have a written policy defining sexual harassment and other forms of harassment at the workplace, stating that the employer will not tolerate said harassment, encouraging victims to come forward and file a complaint, as well as assure a prompt and confidential investigation and resolution of the incident. Minnesota law also ensures that those responsible for the harassment, as well as any supervisors who did nothing about the incident, are held accountable for their actions.
