Texas Woman Sues LA Fitness Trainers for Sexual Harassment

February 7th, 2013    Posted in Sexual Harassment News

Exercise Bikes in LA Fitness Texas Woman Sues LA Fitness Trainers for Sexual HarassmentPlano, TX- A Texas woman is suing LA Fitness and two trainers for sexual harassment after she alleges they subjected her to inappropriate comments during personal training sessions.

Jaime Johnson filed her suit against Fitness International LLC after they refused to refund her membership even though she told them two of their trainers made sexually inappropriate comments during sessions, according to ABC News.

Johnson purchased her membership in 2011 and at first it was going well. She liked her first trainer, but when she was forced to get new ones. Johnson’s two new trainers upset her and made her reluctant to got to the gym.

Johnson’s attorney, Chase Laws told ABC, “He started by making inappropriate comments to her. Not exactly offensive language directed at her but inappropriate things about his lifestyle, sexual activities, things like that.”

Apparently the same trainer asked Johnson to perform exercises so her “could watch her boobs, ABC reported. He also told her he could tell when she was getting a good workout because her “nipples would get hard.”

Disgusted, Johnson stopped going to the gym. She sought out psychological counseling and decided she would return and resume her training sessions. She requested a different trainer, but never told the supervisor of the first trainer about the inappropriate comments.

She was then given a randomly selected trainer, but he was not better and Johnson’s humiliation continued. She was asked to do the same exercises that caused her so much embarrassment with her original trainer.

When she refused to do the exercises the new trainer asked her why? After telling him she felt uncomfortable and related the incident with the previous he laughed “hysterically.”

The next day she received a text from her first trainer asking her if she was suffering from “hard nipple syndrome.”

After that Johnson went to the gym’s administration and told them of the comments and requested they give her a refund for her membership and other services which totaled closed to $3,000. But they weren’t very helpful and instead referred her to the company’s 800-number.

The main office of the gym even knowing of her negative experiences with the trainers offered to give her only $400. She then began the process of severing her membership, but LA Fitness refused to give her an additional refund, that’s when she contacted an attorney.

In the lawsuit, Johnson stated she was trying to recover out-of-pocket expenses, and the costs she incurred from seeking psychological counseling and psychiatric services along with mental anguish.

LA Fitness did not respond to request for a statement.

Late last year, the Elite New York Athletic Club in Manhattan was sued by a former employee who accused the staff and management of sexually harassing numerous employees and patrons. She also alleges staff frequently used racial slurs. The employee’s lawsuit said, “there was a lot of discrimination from management toward employees—and club members toward employees.”  When incidents of harassment were taken to management they took no action against the offenders.

Men Suffer From Sexual Harassment Too

September 10th, 2012    Posted in Sexual Harassment News

When people think of sexual harassment, an image of a helpless female and menacing male figure come to mind. However, while the majority of sexual harassment cases do involve women as victims and men as assailants, men can also be the targets of unwanted sexual conduct.

Although not as common, men can be victimized by other men or even by women. Younger men especially, including boys in school, have often been targeted by classmates, teachers or even religious figures and have been subjected to sexual behavior without their consent.

Now more than ever, sexual harassment awareness is necessary to ensure people protect themselves and are able to report incidents quickly and have them taken care of. Men are often more reluctant to come forward with sexual harassment complaints out of embarrassment, but it is important for all victims to know that doing nothing about the situation will only make matters worse.

If the victim does not complain to an authority figure, the harassment is almost certainly  going to continue or get worse. It is imperative that all victims or witnesses to the incidents come forward so the offender can be brought to justice and so they do not claim another victim.

Anyone who has been targeted by a sexual predator should contact a sexual harassment lawyer immediately to file a claim. Too many times, authorities or human resource departments do not handle sexual harassment matters successfully. CIA Cracks Down on Sexual Harassment

July 5th, 2012    Posted in Sexual Harassment News

WASHINGTON — Following complaints of sexual harassment, the CIA is stepping up efforts to decrease unwanted sexual abuse.

In what it calls a “zero-tolerance” police, the CIA is cracking down on supervisors and co-workers after women working in CIA war zones complained of sexual harassment.

David Petraeus, director of the CIA, sent a message to the agency staff members last month to emphasize the anti-sexual harassment initiative. He ordered a team to meet with senior officers stationed abroad to investigate sexual harassment complaints.

The effort is the result of 2009 and 2011 surveys that demonstrated sexual harassment was taking place on the field.  Several female agents reported having been harassed, often by supervisors.

“This has been going on for years, but it seems to have become more serious,” said a former CIA official who chose to remain anonymous. “The agency has not come up with an effective tool to stop it.”

According to the survey, the majority of the alleged incidents involved sexual jokes or comments.  However, more physical attacks were suggested to have occurred, despite their lack of being reported.

Sexual harassment is a serious crime, but sadly, many victims never come forward out of embarrassment or fear of retaliation. It is important for victims of unwanted sexual assault or abuse to know that they have a right to a safe workplace and can come forward to file complaints.  If you or someone you know is suffering as the victim of sexual harassment, seek legal assistance immediately with a sexual harassment lawyer.

Sexual harassment lawyers work diligently to ensure the perpetrator is held liable for their actions and that victims obtain compensation for their pain and suffering. Speak to a leading sexual harassment attorney to fight for your rights and rid the workplace of hostility.

Tennessee Property Assessor Accused of Sexual Harassment

May 29th, 2012    Posted in Sexual Harassment News

MURFREESBORO, TN – A woman who was fired by Property Assessor Bill Boner in 2009 has accused him of committed several violations, including sexual harassment.

Robbie Allen, who worked in the Rutherford County Property Assessor’s Office for 20 years, told The Daily News Journal she was fired from her position three years ago because she objected to taking certification tests online and opposed Boner’s policy that she disqualify home sales that were outside a 5 percent ratio.

Allen claims she didn’t file a lawsuit at the time she was fired because she was struggling with personal issues, including the loss of her father and because Tennessee is an at-will work state.

Two other women fired by Boner last November filed complaints with the EEOC against Boner in April, alleging he retaliated against them for complaining about inappropriate comments and other matters concerning his re-election.

Allen also accused Boner of sexual harassment, claiming he made inappropriate comments and inappropriately hugged her.

Allen also claims Boner removed one female employee from working the front desk because she was “too fat.”

Workplace abuse charges are very serious but unfortunately, victims don’t always come forward out of embarrassment or fear. It is important for victims to know that help is available to them. If you or someone you know has been the target of a sexual offender in Tennessee, seek the help of a sexual harassment lawyer immediately.

Monta Ellis and Golden State Warriors involved in sexual harassment lawsuit

December 22nd, 2011    Posted in Sexual Harassment News

A sexual harassment lawsuit has been filed against Monta Ellis and the Golden State Warriors.

The suit was filed in Alameda County Superior Court on Wednesday morning, alleging Ellis, 26, Guard for the Warriors, sexually harassed a former employee between November 2010 and January 2011.

According to the victim’s attorney, Burton Boltuch, there is evidence that Ellis sent his client inappropriate text messages at all times of the night, including one with an image that was sent from his cell phone.

Ellis, who was recently married and is a father, never had a physical relationship with the employee but The Warriors are being accused of covering up the sexual harassment incident and firing the employee in retaliation of the complaint. The employee worked in the team’s community relations department for four years.

“They said they laid her off because they didn’t need her,” said Boltuch. “We don’t know of anyone else who’d been laid off.”

Boltuch tried to settle with the team but his efforts failed.

New sexual harassment complaint against Director of Homestead Housing Authority has been filed

November 3rd, 2011    Posted in Sexual Harassment News

Another sexual harassment complaint has been filed against the executive director of the Homestead Housing Authority, Oscar Hentschel.

Deputy Director Monica Rusconi filed a sexual harassment complaint on Wednesday to the Equal Employment Opportunity Commission against Hentschel.

“I feel very uncomfortable around him, and it is affecting our communication. I would appreciate your support during this terrible situation,” wrote Rusconi in an email.

Although a reason has not been given, a board meeting was been called for Wednesday, Nov. 9, just hours after Rusconi sent her email. At last board meeting on Oct. 27, a “third party” was hired to investigate a separate sexual harassment complaint against Hentschel.

Ever since he was hired in March, Hentschel’s employment has been under a close watch. Board member Lois Jones has questioned whether he was hired merely because he is a friend of another board member, David Berrones. Jones also questioned a $20,000 raise that Hentschel was granted, without even having any previous housing experience. He beat out several other extremely qualified applicants for the position.

Chattanooga city employee retires following sexual harassment allegations

October 7th, 2011    Posted in Sexual Harassment News

CHATTANOOGA, Tennessee – Paul Page, Chattanooga’s Director of General Services, who was accused of sexual harassment, turned in his notice to retire on Tuesday morning effective immediately. Investigators found that Page had indeed sexually harassed at least two female city employees and retaliated against them when they came forward about the behaviors. The investigation into sexual harassment allegations began in 2008. One of the victims was fired and the other was moved to another office after filing their respective complaints. “Individuals have a right to work and they have a right to work in an environment that’s free of harassment, hostility and so forth and so on,” said UTC Chief Diversity Officer Dr. Bryan Samuel. The Equal Employment Opportunity Commission is the federal agency that investigates and enforces sexual harassment complaints. It’s their investigation that led Page, who had been a city employee for six years, to retire.

Sexual harassment happens more often than people might think. In 2010, the EEOC received 11,717 complaints of sexual harassment at the workplace. Almost a third of the cases resulted in compensation to the victims. “One of the things I always like to think about is what does that say for all the people who haven’t come forward because they don’t believe that the system will work,” Dr. Samuel said. According to Dr. Samuel, most cases of workplace sexual harassment never get investigated because victims are afraid to come forward either out of fear that the harasser will retaliate or out of embarrassment. However, if the harassment is never reported, it will undoubtedly continue and may even get worse.

“If you don’t report the misconduct of your colleague, your supervisor or what have you then the retaliation laws don’t protect you,” said Dr. Samuel. Following the sexual harassment incident, the City of Chattanooga is making sure all employees take a course to prevent another sexual harassment incident from taking place.

“It’s important to learn what not to do but it’s also important to learn what to do if this ever happens to you,” said city spokesman Richard Beeland.
According to Councilman Jack Benson, Page plans to sue the accusers for defamation of character.

Former City Judge Walter Williams, now in private law practice, is working on a settlement for the victims that could cost the city over $100,000. Sexual harassment is a serious crime and victims have a right to come forward and protect their right to a safe and hostility-free workplace. If you or someone you know has been the subject of a sexual harassment incident, speak to a leading sexual harassment lawyer immediately for help.

Headmaster accused of sexually molesting 40 students

July 15th, 2011    Posted in Sexual Harassment News

MADURAI, Tamil Nadu, India– A government school headmaster has been charged with sexual harassment after allegedly harassing about 40 female students.

Students studying in classes VI to X have filed official sexual harassment complaints against M Arogiasamy, 54, the headmaster of Pothumbu Government High School Madurai.

The students allege that Arogiasamy had been sexually harassing them for the past few months. Some of the girls that resisted his advances were expelled from the school.

Since the accusations, Arogiasamy has disappeared and authorities don’t know where he might be.

“We are trying to find the headmaster’s whereabouts,” said Koodal Pudur sub-inspector Antony Jegatha.

Arogiasamy was booked under IPC sections 354 (outraging a woman’s modesty) and section 506 (criminal intimidation or causing injury). Both sections warrant a punishment of two years each.

The students’ parents said that Arogiasamy had faced similar charges of sexual harassment in 2008 when he was a math teacher at the school. However, education department officials covered up the incident and transferred him to another location to teach. He was then brought back to Pothumbu as headmaster.

The father of one of the victims said that Arogiasamy gained trust from the girls by giving them free books and uniforms. Once he befriended them, he would call them in to attend his “special classes” in which he molested them.

July 14th, 2011    Posted in Sexual Harassment News

PORT WASHINGTON, New York – Three Port Washington sisters have filed a sexual harassment lawsuit against a Long Island restaurant where they used to work.

Lauren D’Annunzio, 20, Ashley D’Annunzio, 23, and Gabrielle D’Annunzio, 21 were allegedly the victims of sexual harassment. In Monday’s lawsuit, filed in federal court, the sisters accused Ayhan’s Fish Kebab Restaurant, the owner of the restaurant, Ayhan Hassan, and the manager of the restaurant, Dario Gomez, of sexual harassment and are seeking unspecified damages.

According to the lawsuit, the sisters claim that they were subjected to lewd comments and behavior by several male workers, including a cook who has been convicted for attacking one of the sisters.

Juan Orellano was convicted of attempted sexual abuse in 2008 and was sentenced to four months in prison for attacking Lauren D’Annunzio in the restaurant’s basement.

“As I came downstairs, he came up behind me and had me in a bear hug,” said Lauren, who was 17 when the incident occurred. “I was screaming for a while and no one heard me and by chance, one of the busboys ended up walking down…and he quickly let go of me and I ran away.”

The other two sisters also claimed they had been touched without their consent.

“They would grab our butts, they would touch our sides and lower to our hips,” said Gabrielle D’Annunzio.

Hassan did not comment on the situation but Gomez said the sisters don’t have a valid case.

“They worked here for a long time and they were happy,” said Gomez.
